WAIVER AND RELEASE OF LIABILITY FOR PARTICIPATION

THIS IS A LEGALLY BINDING AGREEMENT SETTING FORTH CERTAIN TERMS AND CONDITIONS UNDER WHICH, AND IN CONSIDERATION OF WHICH, YOU ARE ALLOWED TO PARTICIPATE IN Sudo Dynamics LLC DBA Fort Worth Combatives EVENTS. READ IT CAREFULLY AND DO NOT SIGN IT IF YOU DO NOT UNDERSTAND IT OR ARE NOT WILLING TO ACCEPT ALL OF THE TERMS AND CONDITIONS IN IT.

I, the undersigned and identified person, desire to participate in events being conducted and administered by Sudo Dynamics LLC DBA Fort Worth Combatives. As an essential component of my consideration to participate in the activities included in and surrounding the events, I hereby enter into and agree to be bound by the terms of this Waiver And Release Of Liability For Participation in events, I on behalf of myself and my heirs, representatives, administrators, and assigns and anyone claiming through you, fully, irrevocably, and forever waive, release, and discharge Sudo Dynamics LLC DBA Fort Worth Combatives. and its directors, officers, members, agents, and representatives, affiliated organizations, and all other class participants (all of the foregoing individually and collectively "Released Parties"), from and against any and all claims for personal injury and/or death to myself or any other person, for property damage of any sort, and for any other claims, demands, causes of action, costs, expenses, attorneys fees, court costs, and liabilities whatsoever relating in any way to league or my presence on the range property (all of the foregoing individually and collectively "Claims"). You further agree to indemnify, defend, and hold harmless all Released Parties from and against any and all Claims arising out of or relating to your presence on the range property and/or your participation in the events. I further agree and represent that neither I, nor anyone claiming through myself, will bring or maintain any suit or cause of action, or make any claim against, against any Released Party relating in any way to the events.

I HEREBY ACKNOWLEDGE UNDERSTAND AND AGREE TO THE FOLLOWING: I understand and acknowledge that
these events involve realistic personal defense training that may result in serious injury or death. I also understand that these
events involve weapons and training weapons, both of which are inherently dangerous and may cause serious injury or death. I
represent that I am attending the events voluntarily and that no one has led me to believe, nor do I believe that Sudo Dynamics LLC. has taken any precautions to protect my safety. I have assumed, and do hereby assume, all of the risks—including but not
limited to substantial risks to my safety and life—associated with my presence at and use of the facilitates and participation in the
events; I will abide by all of the rules and regulations of the facility, the directions of its representatives; and I will use eye
protection at all times; and I fully understand that I and other participants will have access to and will handle weapons and/or
training weapons as an essential part of the event. I further acknowledge that handling and using weapons and/or training
weapons can INVOLVE RISK AND DANGERS of serious bodily harm, serious bodily injury, including DEATH. I fully
understand these risks and dangers may be caused by my own actions, or my own inactions, omissions, the actions or inactions of
other participants in the events, the conditions in which the training takes place (including but not limited to the facility and its
equipment and other facilities or equipment), and/or the negligence of the released named above.

I hereby FULLY ACCEPT AND ASSUME ALL SUCH RESPONSIBILITY FOR THE RISKS DESCRIBED ABOVE while a
participant in the events and I Agree and Warrant that I will examine and inspect each activity or piece of equipment involved in
the events (including but not limited to firearms, ammunition, holsters, firing range, firing range equipment, training weapons,
hearing protection, eye protection, or any other equipment used in or for the events).

I hereby FULLY ACCEPT AND ASSUME ALL RESPONSIBILITY FOR THE RISKS of using any facility or equipment used in or for the events, regardless of the origin or ownership of the equipment. If I observe any activity or equipment, I consider to be hazardous or potential harmful to myself or others, I will notify the instructor immediately and I will refuse to take part in any
activities I consider unsafe until the condition has been corrected to my satisfaction, and I acknowledge, affirm, and agree that I
have had sufficient opportunity to read this entire WAIVER and RELEASE of my rights, that I understand its content, and that it
is legally binding, and that I executed it freely without duress of any nature, and intend this document to be a complete and
unconditional release of all liability to the greatest extent of the law and agree that if any portion of this agreement is held invalid,
the balance shall continue in full force and effect.

THE WAIVER, RELEASE, AND INDEMNIFICATION PROVISIONS PROVIDED FOR IN THIS AGREEMENT ARE
AGREED TO IN EVERY DETAIL, ARE INTENDED TO BE GIVEN FULL AND LITERAL EFFECT, AND SHALL BE
APPLICABLE WHETHER OR NOT ANY CLAIM ARISES SOLELY OR IN PART FROM THE GROSS, ACTIVE, PASSIVE, OR CONCURRENT NEGLIGENCE, STRICT LIABILITY, OR OTHER FAULT OF ANY RELEASED PARTY. YOU HEREBY EXPRESSLY ACKNOWLEDGE AND AGREE THAT THIS STATEMENT COMPLIES WITH THE "EXPRESS NEGLIGENCE RULE" AND CONSTITUTES NOTICE.

We pride ourselves in providing the safest and most structured learning opportunity in all of martial arts, and we are very excited to have you join the family. Please review and acknowledge the following so we can get you started on this martial arts journey. 

I, THE STUDENT OR THE PARENT ON BEHALF OF THE STUDENT, UNDERSTAND that under the terms of this agreement, the school obligates itself to furnish me/my child with competent instruction and suitable facilities for teaching lessons. All class lessons are supervised by qualified personnel trained in the procedures and traditions of Fort Worth Combatives. I agree that I/my child is physically fit to receive and participate in the prescribed course of instruction. I agree to faithfully comply with all the rules and regulations of Fort Worth Combatives. 

TWO WEEK RISK-FREE TRIAL: I understand that I will be granted free unlimited access to classes in the prescribed program(s) at Fort Worth Combatives for 14 calendar days in order to determine if I want to continue with a paid membership. During the 14-day free trial period, I have the right to cancel this agreement for any reason. Cancellation must be submitted using the official Trial Period Cancellation Form provided by Fort Worth Combatives. Verbal, email, written, or text message requests for cancellation will not be honored. 

TWO WEEK RISK-FREE TRIAL UNIFORM DEPOSIT: I understand that I will be charged the retail price of this uniform as a security deposit, and I authorize Fort Worth Combatives to charge the payment method on file for the uniform security deposit, plus applicable taxes. Should I decide to enroll after the trial period is over, the uniform security deposit will be applied to my/my child's account as payment for the cost of the uniform. If I wish to cancel this agreement, it must be done in person and in writing on or before the end of the 14-day trial period. At the time of cancellation, I am required to return the uniform I was provided, washed and in good condition (without tears or stains), at which point 100% of my security deposit will be refunded. Failure to return the uniform at the time of cancellation will result in the forfeiture of my security deposit.

MONTHLY PAYMENTS: I understand that if I enroll in a paid membership after the 14-day free trial that my/my child's tuition payments will be made in monthly installments, and that Fort Worth Combatives has a fiduciary responsibility to collect all payments in a timely manner. Any modifications, changes, amendments, or cancellations of this agreement must be in writing. 

60-DAY CANCELLATION POLICY: I understand that if I enroll in paid membership after the 14-day free trial, I have the right to cancel this agreement for any reason with a 60-day notice using the official 60-Day Notice of Membership Cancellation form provided by Fort Worth Combatives. Any other verbal, email, written, or text message requests for cancellation will not be honored. I understand that I am authorized to train during the 60-day cancellation period in accordance with the terms of my membership agreement. All monthly tuition payments are due until proper cancellation procedures have been followed. In no case shall any monthly payment be retroactively refunded.

NO ROLLOVER CLASSES: I understand that the budgeted tuition payment plan is not affected by my/my child's training schedule and/or attendance. I am aware that any unused classes within my/my child's current billing cycle will not roll over to the next cycle, nor will I be entitled to a credit for these unused classes. Fort Worth Combatives will automatically charge my billing method the discounted rate of $30 (compared to $40 regular drop-in fee) for each class over my monthly limit. 

FREEZE FEE: I understand there is a maximum pause ("freeze") in monthly payments of two (2) months per twelve-month period. If I wish to freeze my membership, a fee of $25 will automatically apply for each month the account is frozen. I understand that, if i am enrolled in Gracie Jiu-Jitsu program, I will have access to the online Gracie University video curriculum during the period for which my membership is frozen.

INJURY POLICIES: I understand that if I/my child becomes injured or disabled for at least three (3) months during the membership period and the injury is confirmed in writing by a physician, I have a right to a freeze the account at no cost or cancel the agreement altogether with a 30-day written notice. 

RESPECT & SAFETY: I understand that belt promotions or other indication of rank is a privilege and not a right. My/my child's acceptance of instruction from Fort Worth Combatives constitutes acknowledgment that I shall treat the students and the facilities with the utmost respect. If at any point, my/my child's behavior is deemed to be unsafe or disrespectful, Fort Worth Combatives reserves the right to cancel this agreement and terminate the membership. I shall be entitled to a refund of all unearned amounts due upon cancellation by Fort Worth Combatives. 

SCHOOL CLOSURES: Fort Worth Combatives administrators may make any modifications to the class schedule as deemed necessary. Such modification does not relieve me of my payment obligations under any circumstances. School administrators also reserve the right to close the school on national holidays, for special events, and for a cumulative period of four weeks per calendar year for necessary maintenance and other purposes without affecting scheduled tuition payments. If the school is closed for more than four weeks, you are entitled to cancel this agreement. 

LATE CHARGE: I understand that a fee of twenty dollars ($20.00) will be assessed for any payments ten (10) days past due. 

DEFAULT PAYMENTS: I assume all responsibility for all costs related to account collections, including but not limited to reasonable collection agency fees, court costs, reasonable attorney's fees, administrative fees and applicable late charges that may be incurred for default payments.

FAMILY MEMBERSHIP DISCOUNTS: Fort Worth Combatives offers a family membership discount program for members who reside at the same billing address and share one billing account. Under this program, the main membership is priced at full price, while the second membership receives a 25% monthly discount and any additional membership receives a 50% monthly discount. The highest price membership is considered the main membership and the lower priced memberships receive subsequent discounts in decremental order of price. If any membership within the family changes, such as upgrading, downgrading, or canceling, or a new family member is added, the family membership pricing will be recalculated. Please note that changes to the family membership pricing structure will be communicated to the main account holder via email. It is important to understand that any such changes will not result in the voiding or termination of the membership agreement.

BY ENTERING INTO THE AGREEMENT I grant the school permission to use photographs, videotapes, artwork or other likenesses of me/my child (the student) for marketing, trade, publishing, or any other lawful purpose, without compensation.

MEMBERSHIP IS non-transferable except as stated herein.

I AUTHORIZE the use of a disclosed e-mail address for billing purposes and acknowledge that e-mail correspondence may include financial information pertaining to the membership.
